The cashless payment Card is an electronic payment system provided and distributed by Payment Solution Services Limited (the Issuer). With respect to the use of the cashless payment Card, these standard terms of use ("Standard Terms") shall govern the relationship between the Issuer and the holder of the cashless payment Card ("Cardholder").
March 27, 2008
§ 1 Contractual relationship
(1) By requesting a cashless payment Card, the Cardholder is entering into an agreement with the Issuer in relation to the use of the cashless payment Card subject to these Standard Terms, which constitute a binding contract between them.
(2) The purchase of any products or services (including event tickets) using a cashless payment Card shall be subject to a separate contractual relationship between the Cardholder and the relevant provider of such products or services and is not governed by these Standard Terms. For the avoidance of doubt, the purchase of a cashless payment Card without the purchase of a valid event ticket does not entitle the Cardholder to entrance to the event.
§ 2 Scope of services
(1) The cashless payment Card allows the Cardholder to make cashless payments for products and/or services from participating providers ("Providers") in and around the arena ("Arena") of Coventry City Football Club ("Club") during the club's home games and such further events for which the cashless payment Card may be accepted, from time to time, by Providers. This may extend to payment for vehicle parking at the Arena.
(2) The Issuer does not provide, and is not responsible in any way for, any products or services offered by any Provider (including their availability) or purchased by the Cardholder using a cashless payment Card, and cannot guarantee that all Providers will accept payment using a cashless payment Card.
§ 3 Obtaining a cashless payment Card
(1) A cashless payment Card may be obtained either from the Issuer's website at
www.cashless-payment.co.uk ("Website"), at approved Ticket sales counters or at designated locations in and around the Arena.
(2) Where a cashless payment Card is ordered from the Website, the Cardholder will be required to pay for the postage and packaging costs for dispatching the cashless payment Card, as indicated on the Website.
(3) The cashless payment Card shall, at all times, remain the property of the Issuer. Possession of the cashless payment Card by the Cardholder only entitles the Cardholder to spend the amount credited on the cashless payment Card. The cashless payment Card is non-transferable and the Cardholder shall not let anyone else use the cashless payment Card they have been issued with.
(4) The minimum value cashless payment Card that may be obtained is £5.00 of which £3.00 will consist of credit that is available to spend and £2.00 which is a refundable deposit but which cannot be used for purchases. The minimum value is subject to change by the Issuer from time to time.
§ 4 Re-charging
(1) The cashless payment Card may be re-charged at any time via the Website (exspected to start in the Summer 2008) and at designated locations in and around the Arena during the opening times for games and other events.
(2) The minimum recharge amount is £5 or a multiple of this figure.
(3) The maximum amount that may be charged to the cashless payment Card at any one time is £150 (or its Pounds Sterling equivalent) and the maximum annual transaction limit is £2,500 (or its Pounds Sterling equivalent).
§ 5 Period of validity
The cashless payment Card is valid for purchasing products and/or services from Providers from the date on which it is issued. The cashless payment Card will expire on 30 June of the Club's football season following the season in which the cashless payment Card was issued. For the purpose of these Standard Terms, the season commences on 1 July and ends on 30 June. For example, a cashless payment Card purchased on or before 30 June 2008 may be used for purchases until 30 June 2009.
§ 6 Payments
The value of any purchase made using a cashless payment Card will be deducted from the balance on the cashless payment Card as soon as it is made. If there are insufficient funds available on the cashless payment Card to cover the amount of the transaction then the transaction will be declined. Other than the available credit on the cashless payment Card, no other form of authorisation is undertaken when paying with a cashless payment Card.
§ 7 Balance refunds
(1) The Cardholder may request a refund of all or part of any credit balance on the cashless payment Card during its period of validity and for up to two years after. Thereafter, no refund will be given.
(2) Refunds may be claimed at designated locations in and around the Arena or, alternatively, via postal return of the cashless payment Card to the Issuer at Payment Solution Services Limited, Ricoh Arena, 71 Phoenix Way, Coventry CV6 6G, or via the Website. Refunds are not available from Providers.
(3) Refunds may be requested in cash (subject to availability) at designated locations in and around the Arena or via the Website by bank transfer to the Cardholder's bank account. A refund by bank transfer is subject to a £2 transaction fee. No bank transfer will be made where the remaining credit on the cashless payment Card is less than £2.
(4) For cash refunds over £80, the Cardholder will be required to produce some form of valid identification (e.g. drivers licence or passport). Where a refund of over £80 is claimed by post or via the Website, the Cardholder will be required to send a copy of their form of identification to the Issuer by post.
(5) The maximum annual refund limit is 1,000 (or its Pounds Sterling equivalent).
(6) The Cardholder must produce and/or return the cashless payment Card in order to obtain a refund. No refund can be given in the event of damage to the storage chip or the imprinted identifiable card ID of the cashless payment Card, unless the Cardholder can provide evidence as to the amount of credit remaining on the cashless payment Card. No refund can be given in the event the cashless payment Card is lost or stolen.
§ 8 Complaints
(1) Complaints relating to any purchases made from Providers must be raised by the Cardholder directly with the relevant Provider(s). The value of any purchase made using a cashless payment Card will not be refunded by the Issuer under any circumstances and any refund must be sought from the relevant Provider(s) directly.
(2) Complaints relating to a cashless payment Card may be made at designated locations in and around the Arena or, alternatively, written complaints may be addressed to the Issuer in writing at Payment Solution Services Limited, RICOH Arena, 71 Phoenix Way, Coventry CV6 6G or sent via e-mail to

.
(3) Any complaint concerning an incorrect amount being credited or debited to a cashless payment Card must be made within six weeks of the incident in question.
(4) The Cardholder may be able to refer unresolved complaints to the Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London E14 9SR, telephone: 0845 080 1800 and e-mail:

(5) The cashless payment Card is an electronic money product regulated by the Financial Services Authority. However, it is not covered by the Financial Services Compensation Scheme. No other compensation scheme exists to cover losses claimed in connection with the cashless payment Card. This means that in the event that the Issuer becomes insolvent, a credit balance held on a cashless payment Card may become valueless and unusable and, as a result, the Cardholder may lose any remaining credit on the cashless payment Card.
§ 9 Safety, loss and misuse
(1) The Cardholder should keep the cashless payment Card safe and in its possession at all times and treat it as if it were cash. Theft of a cashless payment Card should be reported to the police in the same way as any other stolen property.
(2) The Cardholder must not damage, tamper with or misuse the cashless payment Card in any way.
(3) The Issuer is subject to anti-money laundering rules and regulations. The Issuer may suspend the use of the cashless payment Card where, in its reasonable opinion, it is necessary to do so in order to comply with such rules and regulations. The Issuer may request further information about the Cardholder in order to allow certain transactions to be made using the cashless payment Card.
§ 10 Intellectual Property
All copyright, trade marks and all other intellectual property rights in and in relation to the cashless payment Card shall, at all times, remain the property of the Issuer or its licensors.
§ 11 Data protection
Any personal information which the Cardholder may provide to the Issuer in relation to a cashless payment Card will be used by the Issuer in accordance with the privacy policy set out on the Website.
§ 12 Liability
(1) The Issuer gives no warranty and is not responsible in any way for the quality, safety, legality or any other aspect of any products and/or services purchased from any Provider using a cashless payment Card.
(2) The Issuer does not exclude or limit liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability which may not be excluded or limited by law. Subject to this, in no event shall the Issuer be liable to the Cardholder for any indirect or consequential losses incurred by the Cardholder in any way. Any liability the Issuer does have is restricted to forseeable losses.
(3) The Issuer is not liable or responsible for any failure to perform, or delay in performance of, any of its obligations under these Standard Terms that are caused by events outside the Issuer's reasonable control.
§ 13 General
(1) The Cardholder may not transfer or assign any or all of its rights or obligations under these Standard Terms.
(2) If any provision of these Standard Terms is found to be unenforceable, all other provisions shall remain unaffected.
(3) These Standard Terms may not be varied except with the Issuer's express written consent.
(4) These Standard Terms and any document expressly referred to in them represent the entire agreement between the Issuer and the Cardholder in relation to their subject matter. The Issuer is required by law to advise you that contracts may be concluded in English only and that no public filing requirements apply.
(5) These Standard Terms are governed by English law and both parties agree that any dispute between regarding them or the cashless payment Card will only be dealt with by the English courts, provided that, if the Cardholder lives in a part of the United Kingdom other than England, the applicable law of that part of the United Kingdom will govern and any dispute will only be dealt with by the courts there.
(6) The Issuer reserves the right to change these Standard Terms from time to time by changing them on the Website and the current terms will be available on request from designated locations in and around the Arena. These Standard Terms and conditions were last updated on 27 March 2008.
